Accident iPod touch?

I just bought a 32GB iPod Touch a few days ago and for some reason, keeps me crashing back to the main screen when I'm listening to music. I've never jailbroken and Apple did not even give me an exchange because it has been 10 days, and return policy is 7 days. What should I do?

Use your limited warranty from Apple … Describe the problem in your page. They will determine if this is warranted and send you a box for you to send them. But first restore your iPod in iTunes and see if the problem persists after the BTW and the iPod touch is awesome:)
